Terms of Service

Welcome to ListTrim. These Terms of Service ("Terms") govern your access to and use of the ListTrim platform, website, and related services (collectively, the "Service") operated by ListTrim ("we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use this Service. By using ListTrim you represent and warrant that you meet these requirements. The Service is intended for newsletter creators and operators who hold a valid Beehiiv account.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@listtrim.com if you suspect unauthorised access.

You may not share your account with any other person, create multiple accounts, or use the Service on behalf of a third party without their explicit consent.

3. Description of Service

ListTrim connects to your Beehiiv newsletter account via your API key, identifies subscribers who have been inactive (zero opens after receiving more than two emails over at least 60 days), and — on paid plans — removes those subscribers at your direction.

Free-plan users may scan their list and view savings estimates but cannot trigger removals. Starter and Pro plans unlock one-click cleaning, monthly auto-clean scheduling, and CSV export. See the pricing page for a full feature comparison.

4. API Credentials and Data

By connecting your Beehiiv account you grant ListTrim permission to read subscriber data and, on paid plans, delete subscribers you authorise for removal. Your API key and publication ID are stored encrypted using AES-256-GCM. We do not store your subscribers' email addresses beyond the duration of a single scan session.

You represent that you have the legal right and necessary consents to process and delete the subscriber data in question, and that doing so complies with all applicable privacy laws (including GDPR, CAN-SPAM, and CASL).

5. Payments and Subscriptions

Paid subscriptions are billed through Paddle, our Merchant of Record. Paddle collects and remits all applicable taxes (VAT, GST) on our behalf. All prices are shown in USD. Subscriptions renew automatically on a monthly basis unless cancelled before the renewal date.

You may cancel at any time from the Settings page. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not pro-rate partial months unless required by applicable law.

6. Refunds

Our refund policy is described in full on the Refund Policy page. In summary: we offer a 7-day money-back guarantee on first-time paid subscriptions, and pro-rated refunds are not provided for plan changes or mid-cycle cancellations.

7. Prohibited Uses

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Attempt to reverse-engineer, scrape, or copy any part of the platform.
• Use the Service to remove subscribers without their prior consent where required by law.
• Resell, sublicense, or provide third-party access to the Service without our written permission.
• Attempt to gain unauthorised access to our systems or another user's account.
• Upload malicious code or take any action that could harm the platform or other users.

8. Intellectual Property

The ListTrim name, logo, codebase, and all associated content are the exclusive property of ListTrim. Nothing in these Terms grants you any right to use our trademarks, trade names, or other intellectual property without prior written consent.

You retain all rights to your own data (subscriber statistics, export files, etc.). By using the Service you grant us a limited, non-exclusive licence to process that data solely to provide the Service to you.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, ListTrim and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ListTrim and its affiliates from any claims, damages, losses, or costs (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Modifications to the Service or Terms

We reserve the right to modify or discontinue the Service at any time. We will provide reasonable notice (via email or in-app notice) of material changes to these Terms. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes that cannot be resolved informally shall be submitted to binding arbitration. You waive any right to participate in a class-action lawsuit or class-wide arbitration against ListTrim.
